WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY, INCLUDING INJURY AND COMMUNICABLE DISEASES
In consideration of being allowed to participate in any and all Yoga Events for Roxbury Yoga held at Horseshoe Lake Rotary Pavilion, Roxbury, NJ, as well as all programs and related events and activities, the undersigned acknowledges, appreciates and agrees that:
1. By participating in any program that involves physical exercise or activity I am doing so at my own risk and assume the risk of any and all injury and/or damage that I may suffer.
2. Participation includes possible exposure to illness from infectious diseases included but not limited to MRSA, INFLUENZA AND COVID-19. While rules and personal discipline may reduce this risk, the risk of serious illness and death does exist.
3. I KNOWLING AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARRISING FROM THE NEGLIGENCE OF ROXBURY YOGA, it's officers, agents and/or employees and others, and assume full responsibility for my participation and,
4. I willingly agree to comply with the stated and customary terms and conditions for participation as regards to protection against diseases. If however, I observe and any unusual or significant hazard during my presence or participation, I will willingly remove myself from participation and bring such to the attention of the nearest official immediately; and,
5. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Roxbury Yoga, Tracy Kometani and the Township of Roxbury, their officers, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premise used to conduct the events ("RELEASEES") WITH RESPECT TO ANY AND ALL ILLNESS, INJURY, DISABILITY, DEATH or loss or damage to person or property, WEATHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law. In addition I Covenant Not to Sue in connection with all claims (including but not limited to, claims arising from negligence of Releasees or any of them resulting in personal injury, accidents or illness (including death) and/or property loss) arising from or relating in any way to participation in the Activity and/or travel before, during or after Activity.
6. Assumption of Risk
I understand that participating in yoga—especially outdoors—may involve physical exertion and inherent risks, including but not limited to slips, falls, uneven terrain, weather conditions, insects, physical injury, or aggravation of existing conditions. I voluntarily choose to participate and assume full responsibility for all risks, whether known or unknown.
7. Release of Liability
In consideration for being allowed to participate, I hereby release, waive, and discharge the instructor, property owners, event organizers, volunteers, and all associated parties from any and all claims, liabilities, demands, or causes of action arising from my participation in the Activity. This release applies to injuries, damages, or losses of any kind, including those caused by negligence, to the fullest extent permitted by law.
8. Health & Medical Responsibility
I certify that I am physically able to participate in yoga and have consulted a physician if necessary. I agree that I am solely responsible for monitoring my own physical condition during the Activity. I understand that the instructor is not responsible for providing medical care and that emergency medical services may need to be contacted at my own expense.
9. I understand that yoga involves physical movement, breathwork, balance, stretching, and strength‑building exercises. As with any physical activity, I recognize that there is a risk of injury, including but not limited to muscle strain, joint stress, slips, falls, or aggravation of existing conditions. I also understand that this class takes place in an outdoor lakeside pavilion, where natural elements such as uneven ground, weather changes, insects, wildlife, and environmental concerns are not controlled by Roxbury Yoga or the Township of Roxbury.
10. Personal Property
I understand that I am responsible for my own belongings and that the instructor or event organizers are not liable for lost, stolen, or damaged items.
11. Photo/Video Consent (Optional)
I grant permission for photos or videos taken during the Activity to be used for promotional or educational purposes. (Participants may opt out by notifying the instructor.)
12. Acknowledgment & Signature
I have read and fully understand this Release & Waiver. I am signing it voluntarily and understand that by doing so, I am giving up certain legal rights.
